I keep getting contacted by XXXX XXXX of Aldous & Associates about a debt from a gym membership that I attempted to cancel via phone and in-person on several occasions.
While I do not agree with the debt that the entity is attempting to collect, I have answered the phone and found myself talking to an automated voice message from XXXX XXXX XXXX Aldous & Associates, never a real person to discuss the debt collection.
Additionally, I have returned calls to the phone number mentioned in the voicemail to no avail.

On or about XXXX/XXXX/16, XXXX XXXX from Aldon & Associates contacted my aunt XXXX XXXX by phone stating that they were looking for me for a legal case # XXXX. XXXX XXXX has never been listed on any application I have submitted. This creditor is randomly contacting individuals with the last name XXXX disclosing personal information relating to a debt I do not know about. She resides in XXXX, MO and I have not lived in XXXX in over 12 years. Furthermore, XXXX XXXX is a mental health patient whom suffers from XXXX, XXXX and has a XXXX issues. XXXX XXXX contacting her has caused her to have a XXXX and she was XXXX on XXXX/XXXX/16 because of the threatening nature of the call which set her off on worrying that there was a legal case pending against me. On XXXX/XXXX/16, XXXX XXXX received a call from the same company but from a XXXX telephone number but they left the same XXXX number for me to contact them. They are operating outside of FTC guidelines for debt collection practices and disclosing personal information to individuals that they are not legally authorized to do so.

This debt collector engaged in abusive, deceptive, and unfair practices of the FDCPA which it prohibits. They furnished this account that we didn't agree upon and I didn't sign an agreement on. A legal contract is signed by two parties and I did not participate in any of it. More so they didn't follow the proper 5 step validation procedure which make this unfair practices. I went to XXXX XXXX XXXX in XXXX, Alabama to sign up for a gym membership. I was told that I would be paying a monthly fee that would be drafted from my bank. However, I was never informed that I was signing a contract. I was only informed that I was signing a membership agreement and a bank draft authorization. I was never given a copy of the contract to review before I signed it. I only found out about the contract when it appeared on my credit report.
I disputed the charge with my credit card company, and I brought this to the attention of XXXX XXXX XXXX. However, the charge was still marked as accurate.
I am very disappointed with the way that XXXX XXXX XXXX handled this situation. I feel that I was misled and taken advantage of. I would like to request that XXXX XXXX XXXX cancel my membership and remove the charge from my credit report.

Hello I have contacted Aldous and associates collection agency months ago about a debt from XXXX XXXX XXXX XXXX. I asked them to send me validation of this debt along with the correct pay off amount due. After several certified letters and months letter no written reply. And when I called them they nasty rude and unprofessional and basically demanded me to pay an amount I know wasnt due. Spoke to the original creditor XXXX XXXX they told me the amount which was almost {$3000.00} being due. Which they told me that Aldous and Associates do not have the file another credit collection does XXXX XXXX. Which XXXX XXXX sent validation and the correct amount due. I am in contact with XXXX and making payments towards the balance. Why is Aldous & Associates refusing to stop reporting this negative fraud information to my credit reports? I am paying on this same debt to another collection agency.

Albous & Associates P.L.L.C is contacting me even by emails saying that I owe XXXX XXXX XXXX {$190.00} according to contract. I already canceled my membership with XXXX XXXX XXXX and still get emails from them saying my membership is still active. Before I joined on a contract I told them I was not interested they continued to keep calling me asking me to sign a contract I finally had to go in and sign a contract. After I sign the contract the calls stopped but I never went in the establishment or used the equipment. The calls started again when a payment did not go through as they were overdrafting my bank account without permission. I had to close the card and everything. They kept calling me saying I owe Maintance and cleaning fees? For what? Why? I never went to the gym. I never used the equipment. I never broke anything as I did not use anything at the business. I never even bought any drinks from vending machines or use locker rooms. So how do I owe any fees for something I did not use? Why should I pay for damage or cleaning for someone else?

According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states : " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. -This debt collector engaged in abusive, deceptive, and unfair practices of the FDCPA which it prohibits. They furnished this account that we didn't agree upon and I didn't sign an agreement on. A legal contract is signed by two parties and I did not participate in any of it. More so they didn't follow the proper 5 step validation procedure which make this unfair practices. According to the FDCPA I'm entitled to XXXX dollars per violation and clearly they violated my rights.
