Due to first party fraud & identify theft, personal accounts were OPENED and used incorrectly while I was in the hospital. No one was authorized to open an account with XXXX XXXX CREDIT CARDS or TO be able to go in my personal checking account and withdraw money. There was fraud on my account, and I will upload all supporting documents including letters and emails that it was not me and I was not aware of suspicious charges or debit that was taking place on this or these accounts, due to the facts I was in the hospital from XX/XX/XXXX - XX/XX/XXXX. I would like for my funds to be credited back by check and all systems be update over the company so all delinquent past or present XXXX XXXX credit obligation ( s ) be removed from my name and account.

I got my XXXX tax refund on a serve/ American Express XXXX XXXX XXXX I lost the card and trying to get replacement card because I live in Alabama and my rebate has been added to that card. I have called multiple times could not speak to someone who could understand me and was told they had to have the last 4 digits of the old card before issuing a new card I gave them my birthday old phone number and social but was told they needed the last 4 of card and the 3 digit security code. I asked how could I give them that if I didn't have the card had to repeat myself over and over asked to speak to there manager was told they didn't have one was laughed at and hung up on! In Regards to AMEX ACCT # XXXX I am writing to file a formal complaint against AMERICAN EXPRESS for major violations of consumer reporting laws as outlined in the Fair Credit Reporting Act ( 15 U.S.C . 1681 et seq. ) and other relevant statutes. I have found numerous inaccuracies and unauthorized reporting on my consumer report, which have had a significant impact on my financial well-being. Upon reviewing my consumer report, I have identified several instances where American Express has reported late payments, amounts, balances, dates, and other personal information without obtaining my explicit consent. These actions are in clear violation of 15 U.S.C. 1681c, which mandates that consumer reporting agencies must ensure the accuracy and relevance of the information they report. Furthermore, American Expresss unauthorized disclosure of my personal information to third parties raises concerns under 15 U.S.C. 1681b, which requires that consumer reporting agencies obtain permissible purposes before disclosing consumer information to any third party. Moreover, my rights to privacy are protected under 15 U.S.C. 1681a ( q ), which acknowledges the significance of safeguarding consumer information and ensuring that it is used only for legitimate purposes. The unauthorized dissemination of my personal data by American Express violates these privacy rights and undermines the principles of data protection enshrined in the law. Additionally, American Expresss reporting of my consumer account as late for reasons not justified by a delay in payment violates the provisions of 15 U.S.C. 1666b. This statute prohibits treating a consumer account as late on an open-end consumer credit plan without reasonable cause. The unauthorized designation of my account as late without valid reasons further compounds the violations committed by American Express. I kindly request that the following actions be taken : 1. Immediate removal of all inaccurate and unauthorized items from my consumer report, as mandated by 15 U.S.C. 1681i. 2. Cease and desist selling or disclosing any debts, personal information, or other relevant data pertaining to me to any third parties, both in the present and future, in accordance with 15 U.S.C. 1681c. Furthermore, I am aware of the consumer law provisions regarding willful noncompliance ( 15 U.S.C. 1681n ) and civil liability for willful noncompliance ( 15 U.S.C. 1681o ). Given the egregious nature of the violations committed by American Express, I am prepared to pursue legal action to seek damages for the harm inflicted upon me due to their deliberate noncompliance with consumer reporting laws. I appreciate your attention to this matter and kindly request a prompt investigation into my complaint. If necessary, I am prepared to provide additional documentation and information to support my case. Let this serve as notice to American Express that I am prepared to fully exercise my rights and will pursue damages to the full extent of the law. Thank you for your time and consideration.

Based on American Express nonperformance of fiduciary duties and ignorance of the law : Performance in Good Faith : I expect American Express to fulfill its fiduciary duties by promptly performing all obligations to the PRINCIPAL 'S account ending in XXXX and XXXX in good faith.
Principal Account Reinstatement and Opening : American Express must immediately apply the funds to the open the account ending in XXXX and XXXX, which was both wrongly not credited or rendered inaccessible due to American Express fraud department ignorance of the law. The account should be executed and credited without any further delay, enabling me the agent to access the account ending in XXXX and XXXX carry out necessary financial transactions. The Payment statement in the bottom of the coupon states that American Express takes negotiable instruments as a form of payment and my form of payment was mailed in and should be applied to the account.
Credit Issuance to Principal : To rectify the financial harm caused by American Express non-performance, the PRINCIPAL is entitled to receive credits totaling {$13000.00}. These credits must be promptly applied to the account ending in XXXX and XXXX to restore the balance to its rightful amount and compensate for any losses or damages incurred.
Credit Limit Increase : In recognition of the inconvenience and financial harm caused by COMPANY NAME 's non-performance, I request a credit limit increase of {$15000.00} on the principal account. This increase in credit limit will provide the principal with greater financial flexibility and the ability to effectively manage their financial obligations.
Federal Reserve Act Section 29 Fine Collected : The violation of the Federal Reserve Act Section 29 due to American Expresss non-performance of fiduciary duties, I demand that a fine of {>= $1,000,000} be imposed on American Express. This fine serves as a measure of 15 days of notices to American Express to ensure American Express compliance with its fiduciary obligations and to discourage any future negligence, patterns or ignorance of the law.

Dear Representative, I am in desperate need of consumer protection by the CFPB.
I have been a loyal American Express customer for over 17 years.
This complaint will show how American Express intentionally and repeatedly violated my consumer protection rights, cost our small business thousands of dollars, and jeopardized our outstanding business credit.
This complaint will also prove many of the systemic, deceptive, abusive, and unfair business practices and barriers I have faced just to exercise my right as a consumer to dispute a complaint.
These are examples of the unfair and deceptive business practices by American Express : American Express stated in writing that I could provide additional information to defend my claim. Therefore, I reached out to the American Express XXXX, XXXX XXXX to help me resolve the unfair treatment that I have received from XXXX and American Express.
XXXX XXXX replied by email on XX/XX/year> that he would check into my dispute and update me.
The attachment includes the email sent to me by the CEO.
I included this new information from the American Express XXXX in an updated dispute to the American Express online portal.
All I expected from American Express was to suspend the account to review the information from their own CEO.
However, in a cruel, deceptive, and manipulative twist, American Express processed and closed the complaint without a review.
The attachment includes XXXX screenshots which show the complaint submission processed and immediately closed. This is a blatant violation of my consumer rights.
I did not understand how the complaint could be processed and closed without a review. In addition, the online portal would not allow me to resubmit.
Therefore, I reached out to online chat support. After waiting online for another XXXX hours for chat support, a supervisor informed that they were waiting for the complaint to process.
The attachment shows a screenshot verification that American Express received the dispute but immediately closed it without reviewing it. This is an unfair, abusive, and deceptive business practice.
Throughout this dispute process, I have lost revenue due to the technology restrictions imposed by American Express. For example, I have no online updates to the dispute so I have to wait for a response by mail.
I do not have customer service access by phone because my account is closed. This places me in double jeopardy by American Express because by the time I receive their written and unsigned reply by mail with no specific follow up point of contact, I have a very limited time to prepare and submit the response.
Throughout this process, I have asked for XXXX point of contact for consistency and quality control. This request has not been honored. As a result, I have spent hours being placed on hold, being disconnected, and being transferred to personnel who have no authority to help me. When I am finally connected to any one with authority, they have no history on the file. They put me on hold to come up to speed, and the process starts from the beginning.
American Express has caused my small business to lose valuable and much needed revenue.
When my account was erroneously charged while in dispute. I canceled appointments and lost thousands of dollars in revenue so I could spend additional hours in hope of being directed to the correct person/department who could protect our small business line of credit.
These actions by American Express are not an administrative error or oversight. These are intentional and systemic business practices and barriers that prevent me from exercising my right to dispute this charge.
The emotional and financial toll this negligence has placed on my small business is devastating.
In addition, American Express has not updated my account to reflect the dispute that the chat supervisor verified was in processing with American Express on XXXX XX/XX/year>. The attachment shows the XXXX XX/XX/year> pending payment.
Clearly American Express does not plan to honor my new dispute. In addition, it does not appear that the request from their own CEO is being honored.
This is a scary situation for me as a small business owner. As the CEO, our business credit is our lifeline. I am sure that the XXXX would agree that no consumer should be treated this way.
Based on this predatory, deceptive, manipulative, and abusive actions, combined with the revenue I have lost, I would like American Express to permanently credit the amount of {$7200.00} that is due on my account.
I have overcome many obstacles in my life, but today I feel unprotected, bullied, unheard, powerless, and helpless by the unfair, deceptive, and harmful manner that I have been treated my American Express.
I am very thankful for the CFPB for protecting my consumer rights.

American Express is in volition of 15 USC 1681 ( a ) the Fair Credit Reporting Act.
So, 15 USC 1681 ( a ) ( 2 ) ( b ) speaks under the exclusions except as provided in paragraph 3.
The term Consumer Report Does Not include ( a ) ( I ) - a report containing information solely as to transactions or experience between the consumer and the person making the report.
( B ) -any authorization or approval of a specific extension of credit directly or indirectly by the issuer of a credit card or similar device.
American Express is reporting this information on my consumer report making it inaccurate because this information is not included in a consumer report I have sent a letter to american express asking them to delete this information off of my consumer report.
American Express has responded with only billing statements of some alleged debt, ignoring my actual request.
