Complaint What Happened I am currently in a 3 month trial payment plan I have a assigned counselor her name is XXXX XXXX which I have spoken to, and schedule the 3 month payment plan. I first called to speak with XXXX XXXX, after I was unable to get her, I chose to speak with any of the agents which I spoke with a individual name ; XXXX on ( XX/XX/2019 at exactly XXXX XXXX ) I call for 2 things ; 1st to ask if the payment went through for XX/XX/2019 he said that it would probably post from my account tomorrow which was XX/XX/2019. I said o.k, I then asked him when was the next bill suppose to go through he said it suppose to draft from my account on XX/XX/2019. I told him I needed to make a change on the date for this draft out of my account. I would like to have that made on XX/XX/XXXX instead. Mind you me and my husband have had some difficult times with him having XXXX and being out of work for about 5 months. I didnt explain that to the individual ( XXXX ) because I know it was in the computer systems. He made a statement to me, why are you having this come out on the XXXX and then youre gon na have to make another payment on XX/XX/XXXX, it was how he made the state in a degrading way the ( FDCPA Act ) prohibits protects people who need to be treated with dignity and respect and the statement was intent to shame me. After a while I got very fed up with his degrading comment after I explained to him that I didnt like the way he was talking to me he quickly wanted to change it like he was saying it to protect me. I felt very belittle, his actions was very much unnecessary, I also asked him was the conversation being recorded I would so much appreciate if you could listen to this conversation.

Complaint What Happened Recently I fell behind in my mortgage payments XXXX XXXX XXXX XXXX XXXX but Fay Servicing sent me a letter stating that I am XXXX months behind and bc I am in bankruptcy XXXX XXXX XXXX XXXX the automatic stay will be lifted if back payments are not paid in full by XXXX/XXXX/XXXX in the amount of XXXX money I do not have nor do I owe as much this last year has been difficult for me due to unexpected expenses out of my control also losing time off my job. I can afford to pay my mortgage and I want my home. I am now seeking a loan Modification from Fay Servicing. It seems as though they anxiously want to foreclose on my home and that is their only goal. So unfair.

Complaint What Happened XX/XX/XXXX, XXXX sent my loan modified mortgage to Fay Servicing LLC. The assigned account manager, XXXX XXXX, advised XXXX XXXX, that I not send my arranged monthly payments to Fay ( based on XXXX 's calculations ) because Fay had not received all my paperwork. XXXX XXXX was late at sending out new paperwork for me to apply for the same loan modification with Fay. I received Fay 's paperwork XX/XX/XXXX/XX/XX/XXXX. I re-applied with Fay and was denied due to the paperwork not being received in a timely manner. An appeal was requested. I was assigned a new account manager in XXXX XXXX. All paperwork required was submitted in a timely manner. I have now received a foreclosure notice scheduled for XX/XX/XXXX because Fay has not approved the loan modification, even though the loan was modified when they received it and payments were being made.

Complaint What Happened On XX/XX/XXXX, I requested loan documents from Fay Servicing. The account portal has a tab that says loan documents but there are not any documents attached. The enforced insurance information is also not available. There is not a payment history on the dashboard and can not tell who and when a payment was made. The same with statements. Statements do not reflect how a payment was made or when. The response I received from them was that an attorney was handling the mortgage and they needed the attorney 's permission. I am in bankruptcy but my lawyer has provided them several times with authority to speak to me and the Bankruptcy Judge has also ordered that they must speak with me. Fay Servicing is also not reporting information correctly. My husband and I applied for a mortgage loan in XXXX together and should contain reports to both of our social security numbers however, they are only reporting interest payments to my husbands. I have paid over {$50000.00} in arrearages through bankruptcy and Fay continues to try to collect on them. Fay Servicing will not communicate effectively or provide documents.

Complaint What Happened I ask for pay off at first they said it was in bankruptcy they received 3 faxes showing it wasnt., XXXX took his a name off loan, the renters where having it taken out of their account, then on 3rd try they said it was redundant to give me payoff. They mention Texas I have spoke to 4 companies. 3 didnt know about XXXX XXXX XXXXXXXX XXXX XXXX XXXX. Alowed mr XXXX to sign off. But Fay servicing is the one who is to give information. They are holding mortgage information, they are causing more stress than I need. My mental health is not good, neither is my health. I just want payoff so the renters can payoff and have house. Its simple but they are refusing to cooperate. There mean people.

Complaint What Happened The condo at XXXX, XXXX, FL XXXX was abandoned by the owner in XX/XX/XXXX, and has sat empty since. XXXX held the mortgage, and repeated attempts to get them to foreclose failed. In XX/XX/XXXX the mortgage was sold to XXXX. After nine years the condo fees for this unit now total more than {$100000.00} ... an expense that has had to be shared by our 39 other owners. This particular condo was bought at the height of the real estate boom, and it is unlikely the property value will ever return to that level, especially considering a new subdivision next door will soon block our view of the water and lower the property values. Bottom line, the likelihood of the bank making a profit on this mortgage would seem to be very slim. Our 39 other owners have had to pick up the fees and expenses on this unit. Since several are XXXX, this has been a hard financial burden. It has been nine years since the owner abandoned the condo, and several legal attempts to get the foreclosure process started have failed. It makes no sense for any bank to continue paying property tax while our owners assume the expenses of this unit, with no end in sight. A foreclosure will at least end what is a money losing proposition for all parties. We respectfully request that those with the power to start the foreclosure process do so in order for the unit to be sold. We realize we will lose most of the fees, but this will at least put a new owner in the unit, one who will assume their fair share of the complex expenses.

Complaint What Happened My grandmother Insurance company sent fay Service a check to pay off her mortgage. Fay service sent the check back, and the Insurance company sent the check back to Fay service after they received the check they told my grandmother her property is up foreclosure and her check is just sitting into an escrow account. My grandmother never had an issue with her mortgage being paid it. Everything went down hill when Fay service took over. Fay service was taking money out her account twice amount a month.

Complaint What Happened I have not been able to make payments, view my online account or speak to a customer service rep and only leave messages in a general loss mitigation mail box. I have not been notified at all not by regular mail or certified mail there is a sale date on my property for XX/XX/XXXX and that I discovered by a sololiciter I contacted Fay servicing on the XXXX XXXX and stayed on hold for XXXX straight hours to finally speak to the loss mitigation they wouldn't tell me what I had to pay that was behind and I have escrow overage that I requested be applied to principal in XXXX also not done and they have hazard insurance on my home even though I've had homeowners insurance the entire time and provided them with this information. I have not been notified of any delquint payments until the XXXX after I called on the XXXX that is dated the XXXX. They have not offered me any options to avoid foreclosure or notified me at all and I'm blocked out of the online accounts and payments! I desperately need help I don't know what to do if I can't get any information from. Fay or even know the amount behind but I have XXXXXXXX XXXX escrow overage that they refuse to apply to the principal I requested this in XXXX

Complaint What Happened I have concerns over the handling of my mortgage account as well as issues that arose prior to the transferring of my mortgage account from Fay Servicing , LLC to XXXX XXXX XXXX. I feel as if I was taken advantage of financially by Fay Servicing , LLC in the last few months of the company servicing my loan. I also feel that my mortgage loan account was mishandled therefore causing confusion, discrepancies, numerous errors, over assessment of fees and potential unfair business practices.

Complaint What Happened We received a letter in XXXX of XXXX that Fay Servicing was our new servicer for our mortgage which was XXXX XXXX XXXX. We had been with XXXX XXXX XXXX for years and we were pretty close to paying off our mortgage. Once XXXX took over the mortgage, they started demanding the full amount of more than the loan was ever for. We purchased our home in XXXX and started payments around XXXX and had never refinanced our mortgage or anything. The original loan was only XXXX over XXXX years ago and we have made payments on our mortgage and they were claiming XXXX! That means we would have NEVER made a payment on our home in XXXX years. Doesn't make sense. We ended up in bankruptcy a few times off and on since XXXX XXXX and are currently in bankruptcy. We have only been with Fay since XXXX and they have already tried to foreclose on our home 4 times. They are always charging excessive corporate advance fees ( which I do not know what that even is ) and I don't believe payments have been applied correctly. We received assistance from the housing authority last year and they applied XXXX to interest. They also placed hazard and flood insurance on our home in extreme amounts. I have spent days and weeks trying to contact who exactly XXXX Mortgage and get copies that XXXX XXXX XXXX sold the mortgage. Fay 's monthly statements are weird because they all have something a little different about them and they are even missing almost a year 's worth of statements on our online portal. They also do not show payment history or transactions. I have requested insurance information, payment history, and proof of the mortgage asking them to be the servicer. Some of the documents mention a deed of trust and they do not have a deed of trust. I have only attached just a few of the documents. I can send more if needed but wasn't sure how many files it would accept.

Complaint What Happened My account was transferred to Fay servicing in XX/XX/XXXX. My first payment to them was for XX/XX/XXXX which I made through their automated phone system on XX/XX/XXXX. The payment didnt go through so I called a representative and paid that payment around XX/XX/XXXX. From there forward I called every payment in over the phone. The problem at first was that they said my first payment to them was returned. But This is how I found out there was a problem. I got a letter from Fay servicing stating that My payment {$1000.00} changed to {$1300.00} because of an escrow shortage. And it would start XX/XX/XXXX. When I called to make the payment the representative told me that I owed {$1000.00} for XX/XX/XXXX. I told them that I had not missed a payment. They would not take my XX/XX/XXXX payment. I made several calls since then. I have been told everything from my payments were posted to XX/XX/XXXX, two payments were posted to XXXX, and several times I was told that a supervisor would call me within 24hrs which never happened. I was also told that I would be sent a statement showing all payments to them which never happened. Yesterday a representative told me that they had a letter from the previous servicing company saying that I was delinquent. Then she said that she was going to request records from XXXX. This appears to me to be a stalling technique. It appears that they are trying to force me to pay an extra payment which I dont have or even force me into foreclosure. Ive been in a bankruptcy which was discharged on XX/XX/XXXX and I have never missed a payment. I am a XXXX XXXX retired XXXX veteran and I would appreciate any help that you can provide.
