In approximately XXXX the mortgage on my home was sold by XXXX to Nationstar Mortgage. The mortgage was ONLY in my XXXX 's name. I was NOT on the mortgage. On XXXX XXXX, XXXX, my XXXX refinanced the mortgage to take advantage of a lower interest rate and lower monthly payments. He was contacted by a representative of XXXX XXXX who advised they would be handling the refinancing for Nationstar. The representative came to our home with the closing documents for my XXXX to sign. The representative stated that XXXX XXXX required that he have me, as spouse, sign some forms affirming I was legally married to my XXXX. He further stated the signing of these documents would in no way obligate me to be responsible for the payment of the mortgage, it was just a formality. He also advised that within XXXX days of XXXX XXXX, XXXX, XXXX XXXX would transfer everything back to Nationstar and the relationship between my husband and Nationstar would resume as it was prior to the refinancing. Approximately 30 days later, my husband received a letter informing him the transfer back to Nationstar had taken place, and he again began receiving monthly billing statements in his name only from Nationstar. Over the course of the next several years whenever Nationstar would call our home to speak with my XXXX, should I answer the phone and offer to assist them ( in the event my XXXX was unavailable ) I would be told they were not authorized to speak with me because I was NOT on the mortgage. In XXXX XXXX, my husband XXXX XXXX suddenly. I contacted Nationstar and advised them of my XXXX 's XXXX. They stated they were no authorized to speak with me about the mortgage, because I was NOT on the mortgage. I was unable to keep up the mortgage payments on my own. My attorney attempted to speak with them, but to no avail. On XXXX XXXX, XXXX, my attorney forwarded a letter to Nationstar requesting a history of the loan. On XXXX XXXX, I received letters addressed to my XXXX and XXXX to me from a law firm, XXXX informing me of foreclosure proceedings with the auction of my home set for XXXX XXXX, XXXX. The letters were dated XXXX XXXX, XXXX, XXXX days after my attorney requested a history of the loan. I have been unable to get any response from Nationstar as to how it is I was never on any mortgage with them, they always refused to talk to me, and now they are foreclosing on my home against me on behalf of XXXX XXXX, who was only supposed to be handling the closing of the refinancing back in XXXX. It is my complaint that Nationstar and XXXX XXXX have engaged in certainly unfair, and perhaps unlawful, practices in regards to their handling of the mortgage. My deceased XXXX and I were mislead and deceived by Nationstar and XXXX XXXX. And, to add insult to injury, they have refused repeated attempts to communicate directly on this matter.

I HAVE APPLIED FOR HARDSHIP ASSISTANCE ON XXXX/XXXX/XXXX I WAS TOLD BY MY SERVICER NATIONSTAR THAT THEY WILL NOT OPEN UP A REVIEW DUE TO A DISCREPANCY THAT WAS FLAGGED ON MY ACCOUNT ON XXXX/XXXX/XXXX BY MY INVESTOR, I HAVE ASKED WHY WHAT WAS THE DISCREPANCY AND THEY STATE THAT THEY CAN NOT TELL ME.
I CALLED XXXX XXXX TO FIND OUT WHAT WAS THE REASON AND THEY RESEARCHED IT AND STATED THAT THE SERVICER HAS AN ERROR ON THEIR SIDE AND THAT THEY WILL CONTACT THEM TO REMOVE AND CONTINUE WITH THE APPLICATION. AFTER 1 MONTH OF BACK AND FORTH WITH NATIONSTAR AND XXXX XXXX, IT CAME DOWN TO XXXX XXXX CA N'T MAKE NATIONSTAR CORRECT THE ERROR AND I AM ROADBLOCKED NOT KNOWING WHY THEIR IS A DISCREPANCY AND AM IN FEAR I WILL LOSE MY HOUSE DUE TO BEING LEFT IN THE DARK.

My father XXXX XXXX purchased a house for me in XX/XX/XXXX. He passed away XX/XX/XXXX. I am the representative of the estate and the house mortgage is now through Nationstar. Apparently they loss the documentation saying I was the representative of the estate and turned off m ability to make payments on account. I have tried to make payments numerous times as well as my wife. I have called and left messages with XXXX XXXX my account rep. and not return calls concerning this matter. I send in paperwork pertaining to certain issues and they lose after receiving it or say they never got it. Two days ago is when I found out talking to Nationstar that they said they had no paperwork on me as being the representative on my dads estate. Talked to them today and now the paperwork has shown back up. In all this has me in the rears on my payments by 5 months and threatening to foreclose on my house. Now they are saying I cangive them almost {$3000.00} plus lawyers fees to keep my house. My XXXX payments only come to about {$1300.00} which I have been trying to pay and catch up. If Nationstar ahd not screwed up my account like this I would not be behind in payment. The mortgage use to be with XXXX XXXX XXXX and they also lost the paperwork and tried doing the same thing. After my lawyer XXXX XXXX contacted XXXX XXXX XXXX about this matter and they corrected it. Nationstar has not tried in anyway to help all they want to do is take my house. My wife is on XXXX and me trying to do everything and now to try to come up with {$3000.00} to probably {$5000.00} to pay them is ridiculous. I am at my whits end and dont know what to do.

I inherited Nationstar mortgage company- they were not who I initially financed my home with. I have had problems with them since the first month they took over my loan. The first thing was, I have a XXXX. I am in and out of doctor offices, etc. I had paid all my payments on time until one summer when I was able to pay only half and worked out an arrangement to pay other half by end of month. No one ever explained to me that that money would go into a " suspense account '' and would NOT be applied to what I owed! When I went to pay off the months balance, I was given the entire months rate PLUS the next month. When I asked what happened to the half I had already paid, they then explained the suspense count but REFUSED to let it be counted toward what I owed- so in the meantime, they were racking up on late fees and increased interest rates. It has been one problem after another, but this last issue is IT for me- XXXX. I go on XX/XX/XXXX for XXXX. Although my life has literally been turned upside down, I have STILL tried, to the best of my ability, to pay my bills. I made a payment to Nationstar on XX/XX/XXXX and authorized that payment to be taken from MY bank account ( which should have been the ONLY account on file since I pay for this house ), however, my husband and I keep separate accounts and he had made ONE payment for me when I was very sick but did NOT approve keeping his information. Nationstar deducted the mortgage out of his account rather than mine WITHOUT his authorization!!!!! Whether his information was in their system or not ( which it should n't have been since he did n't give them permission )!! I have attempted to rectify this situation but the people you speak with there are rude, disrespectful, uncaring and unwilling to help you WORK OUT A PLAN SO YOU DONT LOSE YOUR HOME- especially when you have been a paying customer for all of these years other than when you are hospitalized or at home so sick that you ca n't even get out of bed- I am tired of this company and their practices and someone needs to look into what they charge their customers and what they actually do with money paid and how they keep other people 's account information on file so they can use it at anytime they please!!!!

The mortgage was sold to Nationstar in approximately XXXX XXXX. The account was current at the time of the transfer and remained current. In XXXX XXXX, homeowners made the payment on XXXX XXXX ( due XXXX XXXX ). Upon receiving XXXX XXXX statement, the account was reportedly one month behind. Upon inquiry, homeowners were told XXXX payment was held in suspense as " insufficient ''. Homeowners were informed their payment amount had risen by {$97.00} due to an escrow shortage. Homeowners paid the {$97.00} and were told the account was current. XXXX XXXX payment was made and processed by Nationstar XXXX XXXX, XXXX ( due XXXX XXXX ). No other notices were received by homeowners until XXXX XXXX when a refund of overpayment to escrow was received. In the month of XXXX, XXXX, homeowners received a notice of intent to foreclose from Nationstar, informing them they owed approximately XXXX and were more than 30 days behind. Upon contacting Nationstar, the homeowners were told that due to an escrow shortage, the account was behind -- even though an escrow refund had been received. Homeowners requested a review of when the account became delinquent. On or about XXXX XXXX, XXXX, the Homeowners contacted Nationstar to get an update on the dispute. They were told to send bank account information, which they did, along with a letter and timeline disputing the missed payment. On XXXX/XXXX/XXXX, homeowners called again and were told the dispute had been referred to the investigations division. On XXXX/XXXX/XXXX, homeowners called again, were told the information sent on XXXX had not been received. Homeowners resent the letter, account info and timeline on XXXX and again on XXXX/XXXX/XXXX. On XXXX/XXXX/XXXX, homeowners called again, spoke to customer representative XXXX ( XXXX ), who admitted there was a mistake with processing by Nationstar. He transferred homeowners to his supervisor XXXX ( ext. XXXX ext. XXXX XXXX ), who informed homeowners the situation would be quickly resolved. Homeowners received several follow up emails about the dispute. In XXXX XXXX, homeowners received a second refund check from Nationstar which they returned to Nationstar, pending the outcome of the dispute. XXXX and XXXX XXXX, homeowners began a refinancing through another lender. The refinance was rejected as Nationstar was reporting their account was more than 30 days past due. Homeowners have received numerous, daily and nightly collections calls from Nationstar throughout XXXX XXXX. On XXXX/XXXX/XXXX, homeowners hired an attorney to contact Nationstar to mediate the situation. On that date, the attorney was informed the account would be referred to investigations division. Upon inquiry as to the outcome of the previous investigation, the representative was unable to see any investigation or resolution report. He informed the attorney the account was past due as a XXXX XXXX payment was never credited to the account. Upon being questioned as to where the payment was posted ( homeowners have sent bank account records, complete with reference numbers for payment to Nationstar for XXXX, payments were direct debit ), he reported he had no authority to state where payment was posted, why homeowners have received XXXX refunds if their account was delinquent, and why the original XXXX XXXX payment was held in suspension for the {$97.00} deficiency ( increase in escrow payment ) when the homeowners were not notified of the increase in their payment before XXXX XXXX and original loan documents do not prohibit " partial payments '' or give authority for " suspension accounts ''. Homeowners have now had negative credit reporting, numerous late fees, continuous harassment in debt collection, and lost time and money for failed refinance, as well as attorney 's fees to dispute the account deficiency.

My mortgage is currently in foreclosure with an auction date of XXXX. The nationstar agent and i reviewed my transaction report and agreed i am no only current but ahead of payment schedule. They said they could not complete due process by the XXXX date and the only alternative, given the time frame, is to send them almost XXXX. I began in XXXX trying to find out why they think i owed them XXXX. It was the last of XXXX when i received a foreclosure letter. I have documentation but the form will not allow me to upload it.

Paying my mortgage on line, it stated my mortgage will go up almost {$200.00} more per month beginning XXXX2017, due to a shortage with my escrow. However, when I called customer service to get an explanation on how my account is negative ( when I have not missed a payment ), along with me reviewing the payment history on my account, it shows there are SEVERAL large payments that were not posted to my mortgage and went to " unapplied funds '' and a " lender paid expense '' payment of {$16000.00} that was also posted under " unapplied funds ''?!?!

I was terminated from my XXXX job & due to the loss/decrease of income, I applied for a modification. Prior to, I had NEVER been late or missed a payment on my mortgage. Nationstar mortgage declined the modification 3 times & sent me a letter that they were foreclosing on my home. The letter stated the sale date was XXXX/XXXX/XXXX. I went to XXXX for assistance, and was told they did not understand why the modification was denied. After XXXX re-applied for the modification for me and it was denied a 4th time, I had no other choice but to file Chapter XXXX on XXXX XXXX, XXXX ( due to XXXX holidays ). However, on XXXX XXXX, XXXX I received a call from Nationstar. The customer service rep stated XXXX XXXX XXXX ( the person that was handling my modification ) no longer worked in that department, but my modification had finally been approved. I explained that I had Just left the attorney 's office to file bankruptcy, to stop the foreclosure and I would need to contact my attorney to see what to do. XXXX XXXX ( my attorney ) advised me to get something in writing, or by email, to verify the modification had been approved, before he cancelled the bankruptcy proceedings. Nationstar refused to give me anything. In XXXX XXXX, they sent me paperwork to complete a 3 month trial period, before the modification would be finalized & approved. I paid all 3 months, completed the " finalized '' modification paperwork & have paid ON TIME every month since XXXX XXXX. My attorney has informed me that once I receive finalized paperwork for the modification, I can convert to Chapter XXXX, or have my bankruptcy dismissed ( since the foreclosure was the reason I filed ). To date, I STILL HAVE NOT received a finalized modification! Every month I call to pay my mortgage and I inquire on the paperwork. Each time I am told it has to go for " booking '' and once this is done, they will send it to me. I do not understand why it has taken over a year and 6 months, and I STILL have not received these papers?!
