Citation text line Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was exposed to a flash fire or explosion hazard: a) Genpak, LLC., Hope Hull, AL location: On or about July 11th, 2015, and prior to, the employer exposed employees to a non-ventilated 53feet long Vanguard standard cube trailer containing 24 non-cured polystyrene rolls off-gas butane, thereby creating a hazardous atmosphere that exceeded the lower explosive limit (LEL) resulting in a flash fire when an employee used a powered industrial truck to unload the trailer.

Citation text line 29 CFR 1910.178(c)(2)(iii): Only approved power-operated industrial trucks designated as EX were not used in atmospheres containing any of the chemicals referenced in this section in quantities sufficient to produce explosive or ignitable mixtures, and where such concentrations of these gases or vapors exist continuously, intermittently or periodically under normal operating conditions or may exist frequently because of repair maintenance operations, leakage, breakdown or faulty operation of equipment: See 1910.178(c)(2)(iii) for list of chemicals. a)Genpak, LLC, Hope Hull, AL location: On or about July 11th, 2015, and prior to, the employer exposed employees to a non-ventilated 53 foot long Vanguard standard cube trailer containing 24 non-cured polystyrene rolls off-gas butane, thereby creating a hazardous atmosphere that exceeded the lower explosive limit (LEL) resulting in a flash fire when an employee used a powered industrial truck to unload the trailer. b) Genpak, LLC, Hope Hull, AL location: On or about July 11, 2015, and prior to, the employer exposed employees to a hazardous atmosphere by failing to require the use of an approved power industrial truck (PIT), such as a PIT designated EX in a non-ventilated 53 foot long Vanguard standard cube trailer containing butane gas in quantities sufficient to produce an explosive or ignitable mixture.
