29 CFR 1926.502(k)(5): The fall protection plan shall document the reasons why the use of conventional fall protection systems (guardrail systems, personal fall arrest systems, or safety nets systems) are infeasible or why their use would create a greater hazard: a) At 300 Fly Creek Avenue, Building 400 The Retreat at Fairhope Village, Fairhope, Alabama: On or about September 4, 2019 and at times prior; the Controlling Employer (Kacco, Inc.) allowed employees of a Sub-Contractor (Eval Construction, LLC) to perform framing activities from the top of framed walls while setting floor joist without fall protection exposing his employees to a fall hazard of up to 30 feet to the ground below. Eval Construction, LLC was using Kacco, Inc. fall protection plan which did not document the reasons why the use of conventional fall protection systems were infeasible or why their use would create a greater hazard. |
