XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX has written off this account. I do not agree with you about having to pay any amount. According to the FDCPA, XXXX XXXX XXXX or any other debt collector has to have consent to communicate with me which you do not have. Any communication after this will be considered harassment.
Under Section 809 ( b ) of the FDCPA, you are required to provide me with the following information before pursuing any further collection activities : Verification of the debt, including the name of the original creditor and detailed documentation of the amount owed.
Proof that you are legally authorized to collect this debt.
Until the requested verification is provided, I request that you cease all collection efforts and refrain from reporting this debt to any credit reporting agencies, as inaccurate or unverifiable reporting violates the Fair Credit Reporting Act ( FCRA ).
Additionally, I demand that you refrain from contacting me except to provide the requested validation or to confirm that you will cease collection efforts.

On XX/XX/XXXX I was furloughed from my full-time job due to the Covid-19 and I wrote my part-time job to informed that I would not return to work as well. I applied for unemployment on XX/XX/XXXX, because I received a letter from my full-time that I would be furlough till XX/XX/XXXX. I got approved for unemployment on Effective XXXX XXXX - XX/XX/XXXX but no longer receive due to returning to work at the part-time job. However, due to Covid-19 my full -time position was no longer needed per CFO. I decided to return to my part-time job on XX/XX/XXXX. Well on XX/XX/XXXX, I received a letter that my pay check will be garnish on XX/XX/XXXX and I was never at work to received the Process of Garnishment letter because I was out on leave and I was unable to respond in the 30 days time frame to the Debt collector. Now I am being garnish for {$6000.00} and not able to reduce the percentage. I feel that this is unlawful and I never even sign any court documents in the first place to even get my wages garnished or to know that my wages will be garnish. I feel that both parties should be held responsible.

I'm quite informed on the legal proceedings in regards to preventing judgements from being entered ( in terms of submitting an answer/requesting a trial date and such ), so I never let me summons/trial notices go ignored ( learned the hard way with a 12 year judgement that took months of research and years finally getting removed without having to satisfy payment ), but was recently issued from small claims a Default Judgment against me, granted to the Plaintiff, XXXX XXXX XXXX, XXXX. I'm quite familiar with the array of debt collecting companies, and I, nor my husband, said that I was served for this said judgement, or I would have answered to it like I normally do, by sending certified answers to both the Plaintiff and the Court. I have no idea how this was granted without my knowledge at all that it was happening. I did access XXXX 's site and logged in, it then said that it can not display my account info at this time and to call Rausch, Sturm, Israel, Enerson. I'm assuming said debt has been sold again? How is a judgement without my knowledge of any of this occurring? The stranger thing is that I DID receive a summons 10 days prior to this judgment being granted, with XXXX XXXX, XXXX, suing me as well. I did send a certified answer to that case number, and received my trial date for XXXX, but I am very confused on how this is possible, if it is, what steps I should take if I swear I was not notified via mail, and if I was, how far back can that summons/serving to the defendant be substantiated for? I was under the impression that there is always 14 days to answer. My only thought is that I possibly may have been served in a previous year, but don't see how that could be possible if the judgement was just granted, since court dates are typically within the next 1-2 months ( that I've experienced, and I've gone to several of these trials ). I'm located in Alabama and would love your input/advice. Should I pay to seek court documents? I do not want to have to pay several hundred dollars to appeal in Circuit Court for a {$1100.00} judgment, but I do not think this judgement is fair. Not sure if I should contact FDCPA or what my next step should be.

I stated I did not open the account nor authorized a account to be open with this company. They sent me to collection company name portfolio recovery who hired a company to sue me Rausch, Sturm, Israel, Enerson and Hornik, LLC and Hornik XXXX sent a summons civil but no answer or reply letter.
