29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 paragraph (b) or (c) of this section. a) 5179 US Hwy 231, Wetumpka AL; On or about July 2, 2014 the controlling employer Paragon Construction & Development, Incorporated failed to ensure that its sub-contractor K & M Mechanical LLC protected its employees from cave-in hazards in that employees were allowed to work inside of an excavation measuring seven feet deep, six feet wide, and fifteen feet in length that was dug in class "c" soil. The employer had not complied with the standard in that employees were not protected from cave-ins by an adequate protective system and the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (thirty-four degrees measured to the horizontal). |
