XXXX XXXX from Waypoint Resource Group responded to a previous claim that " XXXX recalled an account '' What I am referencing does not state XXXX, it states XXXX XXXX XXXX for an amount of XXXX she also lied and said they do not handle credit reporting. Well please explain why WAYPOINT RESOURCE GROUPS is on my credit with XXXX XXXX XXXX listed as the original creditor.
Once again, I never received any information in regard to this fraudulent account that your company ILLEGALLY placed on my credit report without properly notifying me and giving me the opportunity to properly dispute, which is an FCRA VIOLATION on WAYPOINT RESOURCES GROUP part as a debt collection company. You have laws that you have to abide by.
Now I have provided you with an identity theft report from the government website FTC again. This is a second attempt that I'm noting to inform WAYPOPINT RESOURCES GROUP, that they are reporting fraudulent information on my credit report. According to the FCRA laws you are REQUIRED to STOP REPORTING fraudulent information and remove it from said persons credit report once you are made aware and given a government document stating such, please do so.

This collection agency has reported to all three credit bureaus of debt I do not owe. I sent out a debt validation letter to validate this debt and I have not received anything from Waypoint Resource Group. I want this debt removed from all three credit bureaus until they send me a validation letter to validate I owe the alleged debt. If they can not validate this debt again remove from all three reporting credit as it is effecting my credit worthiness.

On XX/XX/XXXX I received an alert from XXXX XXXX regarding a derogatory mark being added to my account. Upon checking into this, Waypoint Resource Group placed this mark upon my credit. It states they are collecting on behalf of XXXX XXXX which has been aquired by XXXX XXXX. I had an account with XXXX from XX/XX/XXXX to XX/XX/XXXX. This account was paid in full and closed upon me moving. Fast forward 4 years and Waypoint Resource Group has hit my credit, collecting on the XXXX account that was paid in full and closed. I called Waypoint Resource Group XX/XX/XXXX and was told by a representative that indeed I owed this " debt '' for {$380.00} and I explained my account was paid in full and closed since XX/XX/XXXX. The representative stated this wasnt true and I owed the supposed debt and tried to collect on it. I explained for the second time, the account was closed and paid in full and the representative stated they would continue to hit my credit and collect and than they ended the call. I work in XXXX XXXX for a XXXX XXXX and am stunned at the collection efforts from this company. First off, I did not receive one phone call regarding this account by XXXX or Waypoint until my credit had a derogatory mark placed on it. I did not receive one written communication from either. Multiple compliance and regulatory laws were broken. FDCPA laws were broken immeditately since no collection attempt was given before credit hits. No debt validation was given. TCPA laws were also breached when the representative said they would continue to hit my credit and collect before they ended the call. The call recordings are recorded im sure, as well as documentation on there end of all collection attempts phone or written. The next step I will take if Waypoint doesnt stop all collection attempts and fix any credit marks is hiring an attorney and subpoena those collection efforts. There wont be any real attempts, because like I stated I havent received one phone call or written communication from XXXX or Waypoint. The only communication was a phone call placed by me to Waypoint XX/XX/XXXX. I am filing this CFPB complaint, a XXXX complaint and the next step will be hiring an attorney and contacting my state attorney general. After I talked with the representative at Waypoint, I noticed similar complaints on their XXXX site, and many if not all had the same issue with no collection attempts before credit hits were placed. In my circumstance, there was no debt since it was paid in full and closed XX/XX/XXXX, and there was no collection attempts to rectify their mistake before hitting my credit. They have numberous similar complaints all within the last month, so I dont know if they have system issues, employee issues or a lack of overall collection knowlegde. Just to reitirate, I want Waypoint Resource Group to stop all collection activity and fix any credit hits on an account with XXXX which was paid in full and closed XX/XX/XXXX. If they cant, an attorney will be hired and all collection activity with be subpoena, as well as the Alabama attorney general contacted and Texas attorney general since thats where Waypoint is located.

I HAVE ATTACHED THE IDENTITY THEFT REPORT, THE LETTER TO WAYPOINT RESOURCE GROUP AND THE NOTICE TO FURNISHER IN THIS COMPLAINT.
All furnishers must have in place reasonable procedures to respond to notifications from CRAs that information furnished is the result of identity theft, and to prevent refurnishing the information in the future. A furnisher may not furnish information that a consumer has identified as resulting from identity theft unless the furnisher subsequently knows or is informed by the consumer that the information is correct. Section 623 ( a ) ( 6 ). If a furnisher learns that it has furnished inaccurate information due to identity theft, it must notify each consumer reporting agency of the correct information and must thereafter report only complete and accurate information. Section 623 ( a ) ( 2 ). When any furnisher of information is notified pursuant to the procedures set forth in Section 605B that a debt has resulted from identity theft, the furnisher may not sell, transfer, or place for collection the debt except in certain limited circumstances. Section 615 ( f ).

I am a victim of identity theft and a fraudulent account was opened under my name with XXXX XXXX in XX/XX/2023. I submitted the appropriate police report and proof of identity theft and this account was verified by XXXX XXXX to be fraudulent as a result of identity theft in XX/XX/2023. I was told by XXXX XXXX at that time 6 months ago that this would resolve the issue ; however, XXXX XXXX still incorrectly instructed the debt collection company they use ( Waypoint Resource Group ) to collect the fraudulent charges from me. I have tried to reach out to Waypoint ( the debt collection company ) 10 times by phone, 3 times by email, and 4 times on their online portal and have gotten absolutely no response. I have never been connected to speak with a live person over the phone and as soon as the recording tells you that " You are about to be connected to a live representative over the phone '' the call beeps and gets dropped. I have reached out to XXXX XXXX multiple times ( who I have read is responsible for taking care of these communicates between their debt collector ) ; however, all 6 different representatives that I have spoken with over the phone with XXXX XXXX have told me that I have to speak to the debt collection company myself. As a result of this inability to get any response from the debt collector, and these continuing outstanding fraudulent charges under my name, my credit score has dropped XXXX points in the past 4 months from XXXX to XXXX. My husband and I are trying to buy a house because XXXX XXXX XXXX ; however, the mortgage loan companies have told me that we need to get this issue with my credit score ( caused by these fraudulent charges ) resolved before we can make an offer on the home we would like to purchase. I appreciate your help very much. Thank you for helping me with this issue.

While checking my credit report I noticed Waypoint Resource Group has a negative remark on my reports stating that I owe a debt that I do not recognize. One entry was for 11 XXXX XXXX XXXX, and from my understanding that is a cable company. I have never used that company for cable service. I have never had cable service. This unverified information has caused a tremendous amount of stress and I plan to hire a credit protection lawyer to look into the matter.

I got a phone call from waypoint Resource group. The collection agent (?? ) demanded I verify an address. I refused as I have my bank account compromised recently. The agent refused to send anything by mail after admitting she had my address. I believe this may be regarding a balance with XXXX XXXX XXXX but I sent the modem back and got no correspondence. XXXX XXXX XXXX And XXXX are in direct violation of the FTC and Cfpb regulations. They are knowing reporting inaccurate information to my XXXX Credit report and are also in violation of USC 15 Section 1681. I am requesting validation of this debt that they say I owe and verification that they have the legal grounds to collect this debt. I also never received written notice of this debt and I am asking that they provide proof of my signature as receiving any certified mail as it pertains to this wrongful collection. Back in XXXX, I mailed a dispute letter to Waypoint Resource Group requesting debt verification. Additionally, the letter instructed Waypoint to stop calling. Verification was not provided, and I continue to receive calls. I received another call today and, via email, was provided with someone else 's XXXXXXXX XXXX. Same name, but I've never been an XXXX customer. The provided billing address didn't even match mine. They have the wrong guy.
