Citation text line OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to stuck-by and crush-by hazards: a) Production Department (Production Racks - Mobile): On or about November, 15, 2021, and at times prior, the employer failed to anchor and bolt down storage racks to prevent employees from exposure to struck-by and/or crush hazards when working near storage racks. Additionally, the employer failed to ensure that a placard indicating the storage racks maximum loading capacity was conspicuously displayed on the racks to ensure the rack wouldn't become overloaded. b) Warehouse Department (Raw Material Storage Racks): On or about November, 15, 2021, and at times prior, the employer failed to anchor and bolt down storage racks to prevent employees from exposure to struck-by and/or crush hazards when working near storage racks. Abatement Note-The yearly audit shall be conducted by an authorized employee other than the one applying the energy control and the written certification shall identify the machine or equipment on which the energy control procedure was being utilized, the date of the inspection, the employees included in the inspection, and the person performing the inspection.
