Complaint What Happened In XX/XX/XXXX, my brother, XXXX XXXX XXXX, a borrower from Seterus Mortgage, suffered a home fire. I, XXXX XXXX, XXXX 's brother, was an Alabama XXXX XXXX at that time, and agreed to give XXXX an estimate for his property repairs, and to share contacts with him that could perform the needed repairs. At no time did I perform any work during the repair project, other than sharing contacts that could perform the work with my brother. XXXX 's home insurance company, XXXX, sent a check for {$25000.00} to Seterus Mortgage. In turn, Seterus, cut a check for the funds, and sent the funds, in increments as the work was completed. XXXX had reported my name as the general contractor for the work, so I endorsed the checks along with my brother XXXX. XXXX was the person who paid all the contractors that I sent to do the work, and has receipts for all the money spent, both on labor and materials. In Spring, XXXX, I received a 1099 from Seterus, stating that the {$25000.00} was considered to be my personal income. I immediately contacted Seterus and was informed by a representative that nothing could be located, and to disregard the 1099. In XX/XX/XXXX I received a letter from the IRS, expecting me to pay taxes on the money that was erroneously reported by the IRS to have been received by me. After speaking to an IRS representative, I was told that I needed to ask Seterus to re issue an amended 10-99, showing that I did not receive this income. After being added as an individual that can discuss the account, by the account holders, and numerous phone calls, both individually and on 3-way call I was told that Seterus needed the receipts showing that the money had been used for materials and labor before they could revise the 1099. On XX/XX/XXXX, I overnighted all the needed receipts and called Seterus two days later to confirm receipt. These were receipts that showed all the money spent, both on labor and materials, and showed that I personally received none of the money. I was told at that they had received the receipts that I would receive a letter within 7 days to confirm their receipt and that another 30 days would be required for them to review and make their decision. After two weeks when I still hadn't received a letter from them I contacted them again asking about the letter. They answered that the letter had been mailed 10 days prior. Today is XX/XX/XXXX and I still have received no letter from them. I contacted Seterus again attempting to resolve this. A representative told me that according to the file he was reading from that my request for a revised 10-99 had been denied by them 3 days ago. Today I still have not received notice of this in the mail. I am only authorized to speak with Seterus regarding this issue until the end of XX/XX/XXXX by the mortgage holders. Seterus has not done what they said in regards to sending me mail documenting receipts that I have sent them. If so, I have not received them. I am concerned that this issue be resolved soon as I am only authorized to speak with Seterus by the mortgage holders through the end of this month. If it is not resolved we will have to go through all the " hoops '' to get this extended for me to be able to continue to discuss this issue. The IRS also, was asking that the amended 10-99 be sent to them by the 3rd week of XX/XX/XXXX.

Complaint What Happened Original Servicer for my Mortgage was XXXX XXXX XXXX who went bankrupt and sold my loan to XXXX XXXX, then sold to XXXX ( XXXX ), who stated during the time of the loan, there had been no payments for the past 389 days. In the mist of resolving the problem ( during my own investigation, retrieving documents from XXXX XXXX verified since all payments were sent by US Mail, because checks were not permitted while in Chapter XXXX. XXXX sold the loan once again to Seterus and added {$25000.00} to the loan. Home purchased at $ XXXX on XXXX XXXX XXXX. While in Chapter XXXX, since XXXX fees were assessed, cost of misc issues assessed. I have a copy of the letter sent to me from XXXX XXXX stating the monies sent to XXXX XXXX for payment of mortgage. I was not sure where to start here but I knew as soon as my BK was cleared I could take some kind of action. I could not afford a Lawyer because all my funds were accounted for. During this time I had to file BK to save my home, we have been in the home for 8 years. Seterus offered me a modification at {$44.00} less than my original payment of {$1700.00} which did not help after 6 months to process. They offered me nothing at this point accept for the XXXX options : Deed in Lieu, Short Sale, or Foreclosure. I have opted to use the Deed in Lieu, which was the only viable option and protect my credit from further damage. In XXXX became XXXX and had to retire from my job which was a lost of $ XXXX a year. This is just the nuts and bolts of this claim and this has had a detrimental effect on my wife and I, who is XXXX as well. I asked for a VA Loan since I am a XXXX year Veteran and they gave me the rules in spite of this gross error in accounting and servicing of my loan.

Complaint What Happened Hello, Setursus mortgage lender took over my mortgage from XXXX XXXX XXXX and we have had problems with our payments going up because of our insurance, we purchased our own insurance where we have our car insurance, seturus was contacted from our agent and was told we will not be paying our insurance through them that it will be bank drafted through our personal banking account because my insurance agent and I had already had this taken care of, they were faxed the declaration by my agent and I also faxed it myself just to insure they received it. Seturus writes a check to my insurance company for a year payment over drafting my escrow account and still raising my payments after being told that we have our own house insurance.

Complaint What Happened Since XX/XX/2016, I have tried to resolve the inaccurate reporting of my mortgage account serviced by Seterus Inc. to the Credit reporting agencies. Today, my mortgage account that I am currently paying on is being reported as closed to the credit reporting agencies. I have contacted a credit reporting agency and Seterus and both blame the other party for how it is being reported as closed. In addition my mortgage is being reported as 30 days late, which I dispute because of my payment changing and not being notified of the short payment. During XX/XX/2016 after my husband file Ch.XXXX bankruptcy, I stopped receiving statements and correspondence from Seterus. My husband is not a signer on the note related to this mortgage. I am a n individual borrower on this loan. However, when I attempted to contact Seterus I was referred the bankruptcy department which would talk to me because they were notified that I was being represented by an attorney. I sent a letter stating I was not in bankruptcy nor was I being represented by the attorney on file in an attempt to correct the confusion. During this time of not getting statements with in a couple of months my mortgage payment amount changes. for one of the months I send in a full payment for the previous amount, however it was not applied but held in suspense, until the next payment was applied. Due to the timing of the next payment, which was not late, the first payment was reported as 30 days late due to the payment being short {$16.00}, the difference in the old an new mortgage payment. I was never contacted of the payment being short, but I was reported the credit reporting agency, knowing that I had never been late in the past. I was told that they could not contact me due to the bankruptcy because it could be perceived as collecting on a debt, however they could report me 30 days late to the credit reporting agency. This seems to be a contradiction and they don't seem want to own any responsibility in the situation that could have been avoided. There are also months where it appears Seterus was not reporting my mortgage as Ok or 'Paying as Agreed ' while payments were being made. The balance on the account was being reported incorrectly for a longer period of time prior to the account showing closed as well. All of this seems to be related to a bankruptcy that I am not a party of, I am not in bankruptcy. Nor is my mortgage a part of my husbands bankruptcy repayment plan. I understand there to be laws that relate to instances where the lien holder is not in bankruptcy, in which my loan information should not be suppressed from me or the credit agency. I feel I have been unfairly serviced, and inconsistent and deceptive practices have caused my loan to be reported inaccurately ultimately impacting my credit score and credit worthiness seen by others. These are a few of the explanations I have received : -My husband lives at the address so it is automatically considered an asset in bankruptcy. So my loan is automatically considered to be in bankruptcy. -The credit reporting agency by law has the right to suppress information on a loan due to bankruptcy. The credit reporting agency is reporting the loan as closed. -Paying as agreed was suppressed by the credit reporting agency in payment history. I can't get either party to resolve the problem, however I understand Seterus to be the party responsible for credit reporting on my loan, the information has to come from them. I am hoping you can assist in this matter that I have been trying to resolve since 2016.

Complaint What Happened Mother passed away XX/XX/XXXX, Father assumed mortgage on home. He passed away XX/XX/XXXX, and his left his friend in the home. I was just made aware the house was still in my mothers name alone, and the person living in the house was not making payments. The house is up for foreclosure and I have tried to contact the mortgage company and they refuse to talk with me even though my brother and me are the only heirs to her estate. An estate was not open XX/XX/XXXX on her due to the fact our father was still alive. I 'm trying to get belonging out of the home and possible save it from foreclosure if they would talk with me.

Complaint What Happened We are behind on our mortgage by XXXX payments and some late fees. My husband arranged for XXXX payment to be made from our checking account on a certain date ( following his next payday ). I have since received XXXX phone call requesting immediate payment of the entire amount owed and XXXX calls that I did not answer ( prior to the scheduled date ). Complaint What Happened On XX/XX/18, my home was hit by a tornado. My neighborhood was designated a federal disaster area. My home was damaged and needs a new roof and other repairs. My insurance, XXXX XXXX, completed assessment and gave me a check for {$13000.00} to complete repairs. But the check was made out to me and my mortgage service company, Seterus , Inc . They have kept the funds and will only release 25 % to each contractor after the contractor signs and completes three forms, one which must be notarized. After all forms are received, they mail 25 %, which can take up to two weeks. Then, once the job is complete, Seterus sends an inspector to take pictures. Then, they wait the full 5 business days, review the inspection, then mail the rest of the funds for the job completed. So, needless to say, when I talk to contractors to get roof estimate and explain the above process, the contractors decide not to work with me as they have plenty of work to do for people who already have their insurance money to complete the work. My roof has still not been repaired as of this date and it continues to leak more and more and cause more damage to my home. Seterus told me they could release 100 % of the funds as less than {$10000.00} was left. They said they could if I found a contractor to complete all repairs and write a letter explaining why the funds are needed up front. I was able to find someone to agree to this. We completed everything Seterus asked for, sent it in, and they still only sent 25 %. I have spoken with them many times asking for them to please send my money. They have money XXXX XXXX gave them for a tree I already paid to remove, which was {$750.00}. This was done day after storm and I don't know how to get in touch with that contractor. There is also money to repair a mailbox and some other small repairs that do not require licensed contractor. Seters did send two payments to the tree removal contractor and electricians. It took such a very long time to receive the money, I was getting calls and texts from the contractors daily. It was so stressful and the continued damage to my home and inability to get my needed repairs done with my insurance money has caused so much stress and trauma following a federal disaster, which was already the hardest thing I have lived through. No one at the company will try to help me or even try to understand when I talk about neighbors two doors down and one street behind whose homes were completely destroyed. I missed work and income due to the storm as well. All I want is for Seterus to release the funds XXXX XXXX provided to me as their longtime customer.

Complaint What Happened I requested my payoff on my mortgage with Seterus inc . They will not give me the payoff on my loan. I told them I had sold my house and needed it. They said it would 48 hrs then next time I called them they said it would take 7-10 days. Then I called them again told them it was urgent and needed my payoff and that I was closing in 2 days. They told me this time it would take 3-5 days. I am having a very hard time just getting my payoff.
