29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: a) Weld out area: On or about December 10th, 2015 an employee (Chris Jeffcoat) was exposed to noise dose at levels of 136.9 %(equivalent to an 8 hour time weighted average TWA of 92.2 dBA) which is 2.74 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while working in the weld out area. Results were calculated for a 443 minute sampling period. b) Weld out area: On or about December 10th, 2015 an employee (JT) was exposed to noise dose at levels of 145.6 % (equivalent to an 8 hour time weighted average TWA of 92.7 dBA) which is 2.912 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while working in the weld out and neck welding areas. Results were calculated for a 433 minute sampling period. c) Main Beam area: On or about December 10th, 2015 an employee (Michael Beckworth) was exposed to noise dose at levels of 83.3% (equivalent to an 8 hour time weighted average TWA of 88.6 dBA) which is 1.66 times the action level of 50% (equivalent to an 8 hour TWA of 85 dBA) while working in main beam welding area. Results were calculated for a 425 minute sampling period. |

29 CFR 1910.141(g)(2): Employees were permitted to consume food or beverage in areas exposed to toxic metals. a)Clark Trailer Service Inc. lunch table in shop: On or about November 19, 2015 and at times prior, the employer exposed employees to heavy metal(s) ingestion by not prohibiting the consumption of food and beverages by employees while performing work tasks where skin contact with heavy metal(s) occurs from the metal trailer welding process and eating and drinking area in the trailer drying area, weld out and neck welding areas. A wipe sample of lunch/break table resulted in the following levels of heavy metal(s): Copper Fume at 15.2320 micrograms, Manganese at 96.1370, Zinc Oxide at 233.220 micrograms, Iron Oxide at 8359.800 micrograms, and 113.5900 micrograms. b)Clark Trailer Service Inc. microwave handle: On or about November 19, 2015 and at times prior, the employer exposed employees to heavy metal(s) ingestion by not prohibiting the consumption of food and beverages by employees while performing work tasks where skin contact with heavy metal(s) occurs from the metal trailer welding process and eating and drinking area in the trailer drying area, weld out and neck welding areas. A wipe sample of the microwave button surface at the weld out area results in the following: Copper Fume at 6.5665 micrograms, Manganese at 18.8100 micrograms, and Iron Oxide at 1414.400 micrograms. |
